These Terms and Conditions apply to the use of www.emmacatharina.com and to purchases made from Emma Catharina through the website or another distance-sales channel operated by Emma Catharina.
Please read these Terms and Conditions carefully before placing an order. By placing an order, you confirm that you have read and accepted them.
Nothing in these Terms and Conditions limits or excludes any mandatory consumer rights available to you under applicable law.

“Emma Catharina”, “we”, “us” and “our” refer to Emma Catharina.
“You” and “your” refer to the person using our website or placing an order.
“Product” or “Products” refers to any item offered for sale by Emma Catharina.
“Consumer” refers to a natural person acting for purposes outside their trade, business, craft or profession.
“Return Portal” refers to the online return and withdrawal function made available through our website.

1.4. If we need to contact you regarding an order, we will use the email address, telephone number or other contact details provided during checkout.
2. Applicability
2.1. These Terms and Conditions apply to consumer purchases made through:
b. any associated online shop, application or digital sales channel operated by Emma Catharina; and
c. any direct distance sale for which we state that these Terms and Conditions apply.
2.2. Separate terms may apply to wholesale orders, retailers, professional buyers and other business-to-business transactions.
2.3. The following information and policies also form part of the agreement between you and Emma Catharina:
a. the relevant Product description;
b. the price and delivery information shown during checkout;
c. your order confirmation;
d. our Shipping and Returns Policy;
e. our Privacy Policy; and
f. any specific conditions expressly agreed between you and Emma Catharina.
2.4. If specific information provided during checkout or in an order confirmation conflicts with these Terms and Conditions, the specifically agreed information will apply to that order, provided that it does not limit any mandatory consumer rights.
3. Changes to these Terms and Conditions
3.1. We may update these Terms and Conditions from time to time to reflect changes in:

b. our Products or services;
c. our website or processes; or
d. applicable laws and regulations.
3.2. The version in force when you place your order will apply to that order.
3.3. Changes made after an order has been accepted will not retrospectively alter the agreement relating to that order.
3.4. The most recent version will be published on our website together with the date on which it was last updated.
3.5. We recommend saving or printing a copy of the Terms and Conditions that apply when you place your order.
4. Eligibility
4.1. You must be legally capable of entering into a binding agreement to place an order.
4.2. If you are under eighteen years old, you may only place an order with the consent and involvement of a parent or legal guardian.
4.3. By placing an order, you confirm that the information you provide is complete, accurate and current.
4.4. You are responsible for checking your delivery address, billing details, email address and selected Products before submitting your order.
5. Product information
5.1. We take reasonable care to ensure that Product descriptions, photographs, materials, colours, measurements, sizing information and other details shown on our website are accurate.
5.2. Images are intended to provide a faithful representation of the Products. However, colours and details may appear differently depending on your screen, device settings, lighting conditions and photographic processing.
5.3. Measurements and dimensions are approximate unless expressly stated otherwise.
5.4. Minor variations that do not materially affect the quality, appearance, fit or intended use of the Product do not automatically mean that the Product is defective.
5.5. Some Emma Catharina Products may be handmade, hand-finished or produced in small quantities. Minor variations resulting from the production process may form part of the character of the Product.
5.6. Such variations are not considered defects, provided that the Product still corresponds with its description and meets the quality that you may reasonably expect.
5.7. You are responsible for consulting the available sizing information, Product description and care instructions before placing an order.
5.8. Please contact us at info@emmacatharina.com before ordering if you require additional information about the fit, dimensions, materials or characteristics of a Product.
5.9. We may make minor changes to a Product where reasonably necessary to:
a. comply with legal or regulatory requirements;
b. improve safety;
c. correct an error; or
d. make a minor technical or production-related improvement.
5.10. Such changes will not materially reduce the quality, functionality or appearance of the Product.
6. Product availability
6.1. All Products are subject to availability.
6.2. Adding a Product to your shopping basket does not reserve it.
6.3. A Product may become unavailable after you place your order, including because of simultaneous orders, a stock error, a quality-control issue or a supplier-related problem.
6.4. If we cannot supply a Product, we will inform you as soon as reasonably possible.
6.5. If you have already paid for an unavailable Product, we will refund the amount paid for that Product using the original payment method.
6.6. We may introduce quantity limits for limited-edition Products, archive Products, promotional Products or Products with restricted availability.
6.7. We reserve the right to refuse or cancel orders that exceed a reasonable quantity intended for personal use.
7. Placing an order
7.1. Our website will guide you through the steps required to place an order.
7.2. Before submitting the order, you will have the opportunity to check and correct:
a. the selected Products;
b. sizes and colours;
c. quantities;
d. delivery and billing details;
e. the selected delivery method; and
f. the total price.
7.3. The final order button will make clear that submitting the order creates an obligation to pay.
7.4. After placing an order, you will receive an automated email confirming that we have received it.
7.5. The automated acknowledgement does not necessarily mean that we have accepted the order.
7.6. An agreement between you and Emma Catharina is formed when we send you an order confirmation stating that the order has been accepted.
7.7. We may refuse or cancel an order before dispatch where:
a. a Product is unavailable;
b. payment cannot be authorised or verified;
c. the delivery address is outside our available delivery area;
d. the order exceeds an applicable quantity limit;
e. we reasonably suspect fraud, misuse or unauthorised activity;
f. the website contains an obvious pricing or Product-information error;
g. additional verification reasonably requested by us is not provided; or
h. fulfilling the order would breach a legal or regulatory obligation.
7.8. If we cannot accept your order, we will inform you and refund any amount already paid for the cancelled Products.
8. Prices and taxes
8.1. Product prices are displayed in the currency selected or made available on the website.
8.2. Prices include applicable VAT or sales tax where required by law.
8.3. Delivery charges and other unavoidable additional costs will be shown before you submit your order.
8.4. Depending on your country and payment method, your bank or payment provider may apply:
a. currency-conversion costs;
b. international transaction fees; or
c. another exchange rate.
8.5. These costs are charged by the relevant provider and not by Emma Catharina.
8.6. For deliveries outside the European Union, import duties, customs charges, local taxes, handling fees and brokerage fees may apply unless checkout expressly states that these costs are included.
8.7. We may change our prices at any time. A price change will not affect an order that we have already accepted.
8.8. Where a price reduction is advertised, the reference price will be calculated and displayed in accordance with applicable price-indication rules.
8.9. Despite our reasonable efforts, a Product may occasionally be incorrectly priced.
8.10. If a pricing error is obvious and could reasonably have been recognised as an error, we may cancel the order and refund the amount paid.
8.11. If the error is not obvious, we will contact you before processing the order. You may then choose to proceed at the correct price or cancel the order.
9. Payment
9.1. The available payment methods are shown during checkout.
9.2. Payment methods may include debit card, credit card, PayPal or another payment service offered by our payment providers.
9.3. Unless expressly agreed otherwise, the full order amount must be paid before the Products are dispatched.
9.4. Payment information is generally processed by authorised payment providers.
9.5. Emma Catharina does not independently store complete debit or credit card information unless this is expressly stated and legally permitted.
9.6. If you choose to save payment information for future purchases, the storage and processing of that information will be governed by the relevant payment provider’s terms and our Privacy Policy.
9.7. If payment is refused, reversed, cancelled or cannot be completed, we may suspend or cancel the order.
9.8. You remain responsible for any lawful fees charged directly by your bank, card issuer or payment provider.
10. Delivery
10.1. Delivery areas, delivery methods, estimated delivery times and shipping charges are set out in our Shipping and Returns Policy and during checkout.
10.2. The delivery information shown during checkout and in the order confirmation applies to your order.
10.3. Unless a different delivery period has been expressly agreed, Products will be delivered without undue delay and no later than thirty days after the agreement is formed.
10.4. Estimated delivery times are not guaranteed delivery dates unless we have expressly confirmed that delivery on a particular date is fixed or essential.
10.5. Products will be delivered to the address submitted during checkout.
10.6. You are responsible for ensuring that the delivery address is complete and accurate.
10.7. Please contact us immediately if you notice an error in the delivery details.
10.8. We cannot guarantee that an address can be changed after an order has been processed or dispatched.
10.9. Detailed provisions concerning delivery delays, tracking, customs, unclaimed parcels, refused deliveries and failed deliveries are included in our Shipping and Returns Policy.
11. Transfer of risk and ownership
11.1. Emma Catharina remains responsible for the Products while they are being transported by a delivery provider offered, selected or appointed by us.
11.2. The risk of loss or damage transfers to you when you, or a third party designated by you other than the carrier, physically receives the Products.
11.3. If you independently appoint a carrier that was not offered by Emma Catharina, the risk may transfer when the Products are handed to that carrier, to the extent permitted by applicable law.
11.4. Ownership of the Products transfers to you once:
a. we have received payment in full; and
b. the Products have been delivered to you.
12. Right of withdrawal and returns
12.1. Consumers residing in the European Union and European Economic Area generally have a statutory right to withdraw from an eligible online purchase within fourteen days after delivery.
12.2. The European Economic Area includes the member states of the European Union, Norway, Iceland and Liechtenstein.
12.3. Consumers residing in the United Kingdom have comparable cancellation rights under applicable United Kingdom consumer law.
12.4. For customers residing outside the European Union, European Economic Area and United Kingdom, Emma Catharina offers a voluntary return period for eligible Products as described in our Shipping and Returns Policy.
12.5. You can register a return or exercise an applicable right of withdrawal through the Emma Catharina Return Portal.
12.6. The Return Portal serves as our online return and withdrawal function and can be accessed through our website without creating a customer account.
12.7. If you are unable to use the Return Portal, you may exercise an applicable right of withdrawal by sending a clear written statement to info@emmacatharina.com.
12.8. You do not need to provide a reason when exercising a statutory right of withdrawal.
12.9. The applicable deadlines, return conditions, exclusions, costs and refund rules are set out in our Shipping and Returns Policy.

12.11. Submitting a request through the Return Portal does not mean that the returned Product has been collected or received by Emma Catharina.
12.12. You remain responsible for returning the Product within the applicable return period.
12.13. The voluntary international return policy does not limit mandatory consumer rights available under the laws applicable to the customer.
12.14. A standard Product described as made to order is not automatically excluded from the right of withdrawal merely because production begins after an order is placed.
12.15. A Product may be excluded where it has been manufactured, embroidered, altered or otherwise produced according to the customer’s individual specifications.
12.16. Sale, promotional and archive Products are subject to the same statutory withdrawal rights as full-price Products, unless a lawful exception applies.
13. Refunds
13.1. Refunds relating to returns and withdrawals will be processed in accordance with our Shipping and Returns Policy.
13.2. If a consumer residing in the European Union, European Economic Area or United Kingdom validly withdraws from an entire eligible order, we will refund:
a. the purchase price of the eligible returned Products; and
b. the cost of the least expensive standard delivery method offered for the original order.
13.3. If the customer selected a more expensive delivery method, such as express delivery, the additional amount charged for that more expensive method will not be refunded.
13.4. If only part of an order is returned, the original delivery costs will not normally be refunded, unless:
a. the delivery costs would have been lower had only the retained Products originally been ordered; or
b. mandatory applicable law requires otherwise.
13.5. For voluntary returns from countries outside the European Union, European Economic Area and United Kingdom, the original shipping costs are non-refundable unless:
a. the Product is faulty or damaged;
b. an incorrect Product was supplied;
c. the order was not delivered in accordance with the agreement;
d. Emma Catharina expressly agrees otherwise; or
e. mandatory applicable law requires those costs to be refunded.
13.6. Refunds will normally be issued using the original payment method, unless you expressly agree to another method.
13.7. We may withhold a refund until:
a. we have received the returned Products; or
b. you have provided satisfactory evidence that the Products have been sent back,
whichever occurs first, where permitted by applicable law.
14. Faulty, damaged or incorrectly supplied Products
14.1. We are legally required to supply Products that conform to the agreement.
14.2. A Product must:
a. correspond with its description;
b. possess the quality and characteristics you may reasonably expect;
c. be suitable for its normal intended purpose;
d. be complete and undamaged; and
e. correspond with any specific purpose expressly accepted by us before purchase.
14.3. Your rights relating to a faulty or non-conforming Product are separate from the right of withdrawal.
14.4. If you believe that a Product is faulty, damaged, incorrectly supplied or otherwise does not conform to the agreement, contact us through the Return Portal or at info@emmacatharina.com.
14.5. Please provide:
a. your full name;
b. your order number;
c. a description of the issue; and
d. clear photographs where reasonably possible.
14.6. Do not send the Product back before reviewing the return instructions provided by us.
14.7. Depending on the circumstances and applicable law, you may be entitled to:
a. repair;
b. replacement;
c. an appropriate price reduction; or
d. cancellation of the agreement and a refund.
14.8. Where a complaint is valid, reasonable return costs will be paid or reimbursed by Emma Catharina.
14.9. Normal wear and tear, accidental damage, misuse, incorrect washing, failure to follow the care instructions or unauthorised alterations are not manufacturing defects.
14.10. Nothing in these Terms and Conditions limits your mandatory legal guarantee rights.
15. Discount codes, promotions and gift cards
15.1. Discount codes and promotions may be subject to additional conditions communicated with the relevant offer.
15.2. Unless expressly stated otherwise:
a. only one discount code may be used per order;
b. discount codes cannot be exchanged for cash;
c. discount codes cannot be applied retrospectively;
d. discount codes cannot be combined; and
e. a discount code must be used before its expiry date.
15.3. We may refuse or cancel the use of a discount code where we reasonably believe that it has been used fraudulently, unlawfully or contrary to its stated conditions.
15.4. If an order paid partly with a gift card or store credit is refunded, the portion paid using the gift card or store credit may be returned using the same method.
15.5. Promotional conditions do not limit statutory consumer rights.
16. Events outside our reasonable control
16.1. We are not responsible for a failure or delay caused by an event outside our reasonable control.
16.2. Such events may include:
a. natural disasters;
b. severe weather;
c. fire or flooding;
d. war, terrorism or civil unrest;
e. industrial disputes;
f. government action;
g. customs disruption;
h. transport interruption;
i. epidemics or public-health emergencies;
j. failure of essential infrastructure; or
k. serious disruption affecting suppliers or delivery providers.
16.3. We will take reasonable steps to minimise the effect of the event and will inform you where it materially affects your order.
16.4. If performance becomes impossible or the delay becomes substantial, you may cancel the affected part of the agreement and receive a refund for Products that have not been delivered.
17. Liability
17.1. Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.
17.2. In particular, we do not exclude liability for:
a. fraud or deliberate misconduct;
b. death or personal injury caused by negligence;
c. defective Products where liability cannot legally be excluded; or
d. a breach of mandatory consumer law.
17.3. We are responsible for losses that are a foreseeable consequence of our breach of the agreement or failure to use reasonable care and skill.
17.4. We are not responsible for losses that were not reasonably foreseeable when the agreement was formed.
17.5. Products sold to consumers are intended for personal use.
17.6. To the extent permitted by law, we are not responsible for business losses, loss of revenue, loss of profit or loss of business opportunity arising from a consumer purchase.
17.7. Nothing in this section limits your right to receive a conforming Product or exercise a mandatory legal remedy.
18. Website use
18.1. We aim to keep our website available, accurate and secure but cannot guarantee that access will always be uninterrupted or free from technical errors.
18.2. We may temporarily suspend or restrict access to the website for maintenance, security, updates or circumstances outside our reasonable control.
18.3. You may not:
a. use the website unlawfully or fraudulently;
b. attempt to gain unauthorised access to the website or related systems;
c. introduce viruses, malware or other harmful material;
d. interfere with the operation or security of the website;
e. scrape or systematically extract website content without written permission; or
f. use our website or content for an unauthorised commercial purpose.
18.4. We may restrict access where reasonably necessary to protect our website, customers, intellectual property or business.
19. Intellectual property
19.1. Unless stated otherwise, Emma Catharina owns or is authorised to use all intellectual property rights relating to the website and its content.
19.2. This includes, without limitation:
a. the Emma Catharina name and logos;
b. photographs and campaign imagery;
c. illustrations and graphics;
d. clothing designs and design details;
e. written text and Product descriptions;
f. videos and audio;
g. website layouts and visual concepts; and
h. other creative or technical materials.
19.3. The website and its content are protected by copyright, trademark, design-right and other intellectual-property laws.
19.4. You may view and temporarily download website content for personal, non-commercial shopping purposes.
19.5. You may not reproduce, publish, modify, distribute, license, sell, commercially exploit or create derivative works from our content without prior written permission.
19.6. Purchasing a Product does not transfer any intellectual-property rights in the Product design, branding, imagery or related content.
20. Personal information
20.1. We process personal information in accordance with applicable data-protection law and our Privacy Policy.
20.2. Our Privacy Policy explains:
a. which personal information we collect;
b. why we collect it;
c. how it is used;
d. how long it is retained;
e. with whom it may be shared; and
f. which rights are available to you.
20.3. Information about cookies and similar technologies is provided in our Cookie Policy or cookie settings.
21. Complaints
21.1. If you have a complaint about an order, Product or our service, contact us at info@emmacatharina.com.
21.2. Please include:
a. your full name;
b. your order number;
c. your contact details; and
d. a clear description of the complaint.
21.3. We will acknowledge and investigate your complaint within a reasonable period.
21.4. We aim to provide a substantive response within fourteen days. If additional time is reasonably required, we will inform you.
21.5. Submitting a complaint directly to us does not prevent you from exercising a statutory right or bringing the matter before a competent authority or court.
22. Governing law and jurisdiction
22.1. These Terms and Conditions and any agreement between you and Emma Catharina are governed by Dutch law.
22.2. If you are a consumer residing outside the Netherlands, this choice of law does not deprive you of mandatory consumer protection available under the law that would otherwise apply to you.
22.3. Any dispute may be submitted to the court with jurisdiction under the applicable mandatory rules.
22.4. Nothing in these Terms and Conditions requires a consumer to bring proceedings exclusively before a Dutch court where applicable law gives the consumer the right to bring proceedings elsewhere.
23. Severability and waiver
23.1. If any part of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that part will be interpreted or limited to the minimum extent necessary.
23.2. The remaining provisions will continue to apply.
23.3. If we do not immediately enforce a right under these Terms and Conditions, this does not mean that we waive that right.
23.4. A waiver will only apply if it is expressly confirmed by us in writing.
